Another justice drops nomination for Chief Justice

SUPREME Court (SC) Associate Justice Conchita Carpio-Morales has withdrawn from the nomination for Chief Justice.
In her letter-reply to the Judicial and Bar Council (JBC), Carpio-Morales expressed her “disinterest” to participate in the council’s nomination process including the public interview of the candidates scheduled on April 19 and 20.
Carpio-Morales earlier accepted her nomination for the said position on the condition that the next Chief Justice will be appointed by the next President in line with Article VII, Section 15 of the 1987 Constitution that prohibits midnight appointments during election period.
She maintained her dissenting opinion in the SC’s ruling in the Arturo de Castro v. JBC case which declared that vacancies in the Supreme Court are not covered by the ban.
In light of this, the Court ordered the JBC to submit its shortlist of nominees to President Arroyo on or before May 17, the day Chief Justice Reynato Puno retires.
